Opportunity Zone Program

  • Funds were created as part of the Tax Cuts and Jobs Act (December 2017) to encourage private investment in low-income communities
  • Bi-partisan Opportunity Zone program included in the 2017 Tax Cuts and Jobs Act and signed into law by the President on December 22, 2017
  • Intended to encourage investment in low-income communities by unlocking the private investment potential of capital gains
  • Allows individual and corporate taxpayers to defer short-term or long-term capital gains on the sale of stock, business assets, or any other property by investing the amount of gain in a qualified opportunity zone fund, and for incremental gain on the sale of O-Fund investments to be exempt from capital gains tax if held for at least ten years

Qualified Opportunity Zones

  • Funds must invest at least 90% of their assets in businesses or real estate located in certain population census tracts designated as qualified opportunity zones
  • The governor of each state (and the mayor of the District of Columbia) was allowed to nominate up to 25% of the qualified census tracts in their state as O-Zones
  • Selected qualified opportunity zones have been officially approved by the federal government for all states and the District of Columbia
  • Qualified census tracts” generally have poverty rates at or above 20%, or median incomes at or below 80% of the metropolitan area median income or the statewide median income
